【聲援行動】看護工周休1日24小時,譴責勞動部傲慢怠惰

陳情內容:

6月16日是國際家務工日,桃園市家庭看護工職業工會在此代表全台灣的外籍家庭看護工,向勞動部陳情,表達家庭看護工「放假是基本權利」的訴求,懇請台灣社會正視家庭看護工全年無休、遭受強迫勞動的困境。

2011年,國際勞工組織(ILO)於日內瓦大比數通過189號公約,即《家務勞動者公約》,承認「家務工是工人」,應享有與其他工人平等的勞工權利。此公約為家內勞動者勞動條件設立國際準則,其中即規定家內勞動者有每天的休息時間,以及每星期至少連續24小時的休息日。對於在台灣的家庭看護而言,然而,根據勞動部的調查,在台灣的23萬多名外籍家庭看護工、家庭幫傭,有6成以上根本未曾放假。

而即便有放假的外籍家庭看護,也無法獲得連續24小時的休息,在仲介惡意誤導雇主看護不得外宿的狀況下,大多數看護每次放假只有12小時,甚至5、6個小時,但剩下的工時竟未被列入加班費計算。導致家庭看護休息半日、做白工半日的情形屢見不鮮。

由於工會多數會員都處於沒有放假的狀態,為了參與訴求表達,她們將自己的衣服剪成布塊,寫上心聲並簽名,郵寄給工會縫成一條「請願百衲被」,象徵身體雖被禁錮無法現身,仍渴望表達「依法放假」的心聲,目前已募集近千張布塊。

美國國務院發布之2017人權報告指出,台灣法律雖然禁止一切形式的強制勞動,也制定處罰細則,但因為法院多半判決輕罪或罰款,不足發揮有效威懾作用。報告指出,這類強制勞動常發生在家政服務、農漁業、製造業與建築業等行業,外勞最容易遭到剝削。現實的情況是,雇主不准外籍看護工放假,看護工以此為由向1955申訴,1955只會答覆雇主未違法,難道勞動部要繼續縱容家庭看護的人權遭受踐踏貽笑國際?

在現行長照規定中,聘僱外籍看護之雇主無法申請喘息服務補助,對於重症患者的家屬而言,根本苦不堪言,願意尊重人權讓家庭看護放假的雇主必須進入「第二輪班」,許多雇主根本不能接受家庭看護放假,更何況外國人總有返鄉探親的需求,在沒有替代人力補助的現況,請求放假彷如從雇主身上割肉,請政府不要再放任雇主與家庭看護弱弱相殘!

Appeals:
1. Caretakers shall have 1 day off per week, and not be forced to work overtime on their day-offs.
2. Day off means complete 24 hours, and the worker can’t be forced to stay in the employer’s house.
3. Government should subsidize the Employers to hire replacements.

Petition Contents:

June 16 is International Domestic Workers’ Day. In front of Ministry of Labor, Taoyuan Domestic Caretaker’s Union is going to give out our petition and campaign for our BASIC rights: DAY OFF. We are calling for an attention to the no-day-off and forced-working situation of domestic caretakers in Taiwan.

On June 16 , 2011, International Labor Organization(ILO) in Geneva overwhelmingly passed C189: Domestic Workers Convention, which recognized that "domestic caretakers are workers” and should have the equal rights with other workers. The convention sets international standards for working conditions in the homes for domestic workers, which stipulates clearly of a daily rest period and at least 24 consecutive hours of rest each week. However, according to the statistics from Ministry of Labor, over 60 percent of foreign domestic caretakers or helpers don’t have any day offs at all.

And for those caretakers who have day offs are unable to obtain consecutive 24 hours of rest. Under the malicious misleading by the brokers, employers usually think that caretakers should not stay out overnight. On that premise, most caretakers can get no longer than 12 hours, even sometimes less than that, only 5 or 6 hours off. But the remaining working hours are not paid with an overtime payment, worse than that, the hours are not paid at all. It’s common that most of the home-based caretakers have half day off and the other half they work without any payment.

Most of the union’s members have no day offs, but they wish to participate the campaign in their own ways; the requests and appeals were written on the cloth cut from each worker’s clothes, with their names and signatures on and were mailed to the union. The officers in the unions used this cloth from the members to sew a ‘Petition Patchwork Quilt’, which shows that even without the workers’ physical presence, their strong wish of having day offs according to the law should be heard and known by the public. Now we have already gathered almost a thousand pieces of cloth.

In the 2017 Human Rights Report released by the State Department, it points out that although Taiwanese law bans all forms of forced labor, and formulate detailed rules for the punishment, but most of the court rulings of the cases are misdemeanors or fines, which are lack of effective deterrent effect into full play. The report says such forced labor is most likely to be exploited in domestic service, agriculture, fisheries, manufacturing and construction and most cases are foreign workers. The reality is that employers don’t allow foreign workers to have day offs, even the workers call 1955 and request for help, the staff of 1955 usually reply them that the situation doesn’t violate the law. Is the Ministry of Labor going to ignore this abuse of caretakers’ human rights and leave Taiwan to ridicule of the international society ?

In the Long-term Care Policy right now, families that employ foreign caretakers cannot apply for respite care service. For the families with seriously ill patients, it is extremely painful if there’s no support from the government. And for those employers who care about caretakers’ rights, many of them have to take the second shift after work. And a lot of families are not willing to give caretakers day offs, not to mention giving the caretakers a long period to go back to the hometown to visit their families. Without the alternative of substitute manpower of caretakers, asking for day offs from those families with seriously ill patients is actually pushing them into a dead end. We appeal to the government not to let employers and caretakers, who are both vulnerable groups hurt each other’s rights.
